Compliance audit and its challenges

1Click Games started its gaming operations under the Malta Gaming Authority (MGA) B2C gaming license on April 7, 2021. It means a year has passed already since we started our gaming operations. What does it mean for 1Click Games in the nearest future? Compliance review!

The MGA mandates that after going live, a licensee must undergo several compliance audits of its operations performed by an approved Service Provider appointed by the licensee. Such audits need to be completed by the Service Provider within 90 days from the MGA's notice.

In October 2021, the MGA invited the gaming industry, service providers as well as wider interest groups to express their views and provide feedback in relation to the Revised Audit Service Provider Guidelines (Guidelines). The MGA intends to publish the final version of the Guidelines and any other supporting documents by the end of Q2 of 2022.

Considering the upcoming legislation changes, we expect that the compliance audit request by the MGA will be received after the amended Guidelines are published – we are monitoring closely. To be fully prepared for the upcoming compliance audit and to reassure that we operate in compliance with the gaming, anti-money laundering, responsible gaming, and data protection regulations, 1Click Games will perform its internal compliance audit in the further months.

Why the compliance audits might be challenging? Trying to apply, the regulatory requirements are always a bit grey area. Gaming operations don't always fit into a perfect black-or-white regulatory environment. It requires thought and interpretation on how to comply with the requirements. The problem occurs when the licensees assess the risks, apply controls to address the risks, and the gaming authority doesn't agree with the licensee's approach. Nevertheless, 1Click Games is confident in its gaming operations being compliant with the regulations, since 1Click Games has implemented identifying and assessing risks & identifying measures to reduce risks.
